Xiamen has debuted a pioneering model for resolving aids to navigation collision disputes — the first of its kind in China. This "Xiamen Solution" offers a streamlined approach to maritime dispute resolution, with arbitration as its recommended core.
Facilitated by the Xiamen Free Trade Zone Administration, seven Xiamen maritime-related institutions signed a cooperation memorandum. This memorandum establishes a "mediation-arbitration-litigation" multiple dispute resolution mechanism that encourages arbitration for aids to navigation collision and other maritime accident disputes.
Simultaneously, they inaugurated the Xiamen Arbitration Commission's Rapid Liaison Point for Mediation-to-Arbitration of Aids to Navigation Collision Disputes.
The resolution of aids to navigation collision and maritime accident disputes has long faced persistent challenges, including protracted timelines, high specialization, and cross-border enforcement hurdles.
To tackle these pain points, the new mechanism creates efficient "green channels". These include fixed liaisons, guaranteed immediate arbitration response, and regular meetings, enabling a seamless "maritime investigation-mediation-arbitration" pipeline. As a specialized model of the broader "mediation-arbitration-litigation" framework, it provides a robust, actionable framework for enhancing Xiamen Port's business climate.
